NOTICE OF RIGHTS, ATTRIBUTION AND UNAUTHORISED USE

This notice supplements the Terms of Use and Disclaimer published on this website and forms part of Bioratorium Limited's stated position concerning the protection and authorised use of its intellectual property, research, creative works, proprietary concepts, brands and associated identity.

Bioratorium Limited ("Bioratorium®", "we", "us" or "our") reserves all rights in and to the material published through this website and associated Bioratorium® channels, except where a different rights holder or licence is expressly identified.

2. EXPRESS RESERVATION OF RIGHTS AGAINST ARTIFICIAL INTELLIGENCE TRAINING AND DATA MINING

Bioratorium Limited expressly reserves its rights in relation to the use of its copyright works and other protected material for text and data mining, artificial intelligence training and related computational purposes.

Unless Bioratorium Limited has expressly granted a written licence permitting such use, no person, organisation, artificial intelligence developer, model provider, dataset operator, technology company, platform or other entity is authorised to:

  • crawl, scrape, harvest or systematically extract content from this website for the purpose of creating or augmenting an artificial intelligence dataset;

  • copy or ingest website content into a training, pre-training, post-training, fine-tuning or reinforcement-learning dataset;

  • use website content to train, develop, improve, benchmark, evaluate or validate an artificial intelligence or machine-learning model;

  • incorporate website content into a foundation model, large language model, multimodal model, generative AI system or other machine-learning system;

  • create embeddings, vector databases, semantic indexes or comparable machine-readable representations of protected Bioratorium content for unauthorised AI or commercial use;

  • use the content as retrieval material for a generative AI, RAG or comparable automated system where such use has not been expressly authorised;

  • systematically extract, reproduce or transform content for the purpose of building a competing knowledge base, dataset, corpus or AI service;

  • use our content to generate derivative synthetic works intended to substitute for, reproduce, emulate or commercially exploit the original works;

  • use our research, terminology, conceptual frameworks or original creative material as undisclosed training material for a commercial AI product; or

  • circumvent technical, contractual, metadata-based or other measures used to communicate or enforce these rights reservations.

Access to this website for ordinary human browsing does not constitute permission for automated collection or computational exploitation for any of the purposes described above.

3. MACHINE-READABLE AND TECHNICAL RIGHTS RESERVATION

This notice is intended to constitute an explicit reservation of rights in respect of text and data mining and AI-related uses of protected material.

Bioratorium Limited may additionally communicate or reinforce this reservation through machine-readable mechanisms, crawler instructions, metadata, headers, structured data, robots exclusion protocols, AI-specific exclusion mechanisms, registries or other technical standards as they become available or applicable.

The absence, incompleteness or technical failure of any particular machine-readable signal shall not be interpreted as consent, authorisation, waiver or abandonment of rights.

Where applicable law provides a mechanism through which a rights holder may reserve rights against text and data mining, this notice is intended to communicate Bioratorium Limited's reservation of those rights.

AI developers, model providers, dataset operators and other automated systems are therefore expected to implement reasonable procedures for identifying, recording and respecting this reservation.

4. PROHIBITION ON UNAUTHORISED COMMERCIAL AI USE

Particular objection is made to the commercial exploitation of Bioratorium® content by AI companies or other commercial entities without prior written permission.

This includes, without limitation, using Bioratorium® content:

  • to develop or improve a commercial AI product;

  • to create a commercial training dataset;

  • to create a searchable proprietary corpus;

  • to generate commercial answers, reports, designs or recommendations derived substantially from our protected material;

  • to reproduce or synthesise our research or intellectual property within an AI product;

  • to compete with Bioratorium's services, publications, research or educational offerings; or

  • to facilitate commercial exploitation of our intellectual property by customers or downstream users.

A company's ability to technically access a publicly available webpage does not establish permission to use that webpage for any of these purposes.

5. RESEARCH, ATTRIBUTION AND PROVENANCE

Bioratorium® recognises legitimate scholarly, journalistic, educational and other forms of human engagement with published research, subject always to applicable law and the rights reserved by the relevant rights holder.

Where Bioratorium® material is lawfully referred to, quoted or reproduced under an applicable exception, licence or permission, appropriate attribution and provenance must be retained.

Attribution should identify, where relevant:

Attribution does not itself create a licence for reproduction, commercial exploitation, AI training or other uses requiring permission.

6. ORIGINAL RESEARCH, CONCEPTS AND PROPRIETARY TERMINOLOGY

Bioratorium®'s intellectual property includes not only individual documents or images, but also original bodies of research, conceptual systems, methodologies, terminology, nomenclature, design propositions and combinations of ideas and expressions developed through its work.

The unauthorised extraction, aggregation or computational reconstruction of such material may result in a substantially similar body of work even where individual passages are not reproduced verbatim.

Accordingly, this notice applies to unauthorised systematic extraction and reuse of the substance, structure and expressive content of Bioratorium®'s protected works, to the extent protected by applicable law.

7. IDENTITY, NAME, REPUTATION AND PERSONA

Bioratorium®'s intellectual property interests are distinct from, but may overlap with, rights and interests associated with the professional identity of Dr. Melissa Sterry.

No person or organisation is authorised, without appropriate permission, to use the name, professional identity, biography, image, likeness, voice, presentations, interviews, quotations or other identifying characteristics of Dr . Melissa Sterry or Bioratorium® in a manner that:

  • implies endorsement, sponsorship or affiliation;

  • falsely represents authorship;

  • attributes another person's work to her;

  • attributes AI-generated material to her;

  • creates a false impression that she has participated in developing, approving or validating an AI system or output;

  • uses her identity to promote an AI product, service or model;

  • creates or publishes a synthetic representation intended to impersonate her;

  • associates her identity with statements, opinions, research or works she did not create or endorse; or

  • otherwise misrepresents her professional identity or relationship with a person, organisation, product or service.

Nothing in this section is intended to restrict lawful criticism, reporting, commentary, satire or other activity protected by applicable law.

8. NO IMPLIED LICENCE FROM PUBLICATION

Publication on the internet is not abandonment.

The fact that content can be accessed, indexed or technically downloaded does not mean that Bioratorium Limited has granted an unrestricted licence to copy, reproduce, mine, aggregate, train upon, transform or commercially exploit that content.

Unless expressly stated otherwise, all rights are reserved.

9. THIRD-PARTY AI SYSTEMS AND AI-GENERATED OUTPUT

Bioratorium Limited does not authorise third-party AI systems to represent themselves as Bioratorium®, to claim that Bioratorium® has endorsed their outputs, or to present generated material as original Bioratorium® research where that material has not been authored or approved by Bioratorium®.

Where an AI system produces material substantially derived from protected Bioratorium® content, the operation of that AI system does not extinguish the underlying rights in the source material.

Any person or organisation using an AI-generated output remains responsible for determining whether the underlying material has been lawfully obtained and used.

10. DATASETS, MODEL TRAINING AND DOWNSTREAM SYSTEMS

Any unauthorised inclusion of Bioratorium® content in a dataset, corpus, model, training pipeline, retrieval system, vector store, knowledge graph or comparable computational resource is expressly disputed.

Where Bioratorium® discovers that its material has been incorporated into an unauthorised dataset or AI system, it reserves the right to request:

  1. identification of the relevant dataset, model, system or service;

  2. identification of the source and method by which Bioratorium® material was obtained;

  3. identification of the categories and quantities of Bioratorium® material used;

  4. removal or exclusion of the relevant material where legally available;

  5. confirmation of the cessation of further collection or use;

  6. preservation of relevant records concerning acquisition and use;

  7. appropriate attribution where attribution is legally required; and

  8. such other remedies, compensation, licensing arrangements or injunctive relief as may be available under applicable law.

11. MONITORING AND ENFORCEMENT

Bioratorium Limited reserves the right to monitor publicly accessible use of its intellectual property and to investigate suspected unauthorised copying, scraping, dataset inclusion, AI training, identity misuse, false attribution and other infringement.

Where appropriate, Bioratorium Limited may pursue available remedies against individuals or organisations responsible for unauthorised use, including requests for removal, licensing discussions, claims for damages or other financial remedies, injunctive relief, preservation of evidence and other remedies available under applicable law.

Nothing in this notice limits any rights or remedies available to Bioratorium Limited or any other relevant rights holder.

12. LICENSING AND PERMISSIONS

Bioratorium Limited may, at its discretion, grant specific written permissions or licences for particular uses of its content.

Requests concerning:

  • reproduction;

  • republication;

  • licensing;

  • commercial use;

  • educational use;

  • research use;

  • media use;

  • AI training;

  • dataset inclusion;

  • computational analysis; or

  • other proposed uses

should be made directly to Bioratorium Limited before the proposed use takes place.

No permission should be inferred from silence, previous publication, website accessibility, search-engine indexing, social-media sharing, or the absence of a technical blocking mechanism.

13. PRE-EXISTING RIGHTS AND APPLICABLE LAW

This notice supplements, and does not replace, the Bioratorium® Terms of Use and Disclaimer.

Nothing in this notice is intended to assert rights beyond those available to Bioratorium Limited or other relevant rights holders under applicable law.

The interpretation and enforcement of these rights will depend upon the applicable jurisdiction, the nature of the work concerned, the identity and location of the relevant parties, the manner in which the material was obtained and used, and any applicable statutory exception, limitation, licence or other legal provision.

Bioratorium Limited reserves the right to update this notice as legislation, case law, technical standards and AI-related practices develop.
